    Chairman Manchin moves to amend the amendment at pages three and four, section four, by striking out section four in its entirety and inserting in lieu thereof the following:

“§16-4F-4. Standards of care. 

    (a) A health care professional who provides expedited partner therapy in good faith without fee or compensation under this article and who prescribes antibiotic drugs to the sexual partner or partners of a patient diagnosed with a sexually transmitted disease in accordance with the provisions of this article shall not be deemed to have violated the standard of care for such expedited partner therapy or prescribing in any civil or criminal action. 

    (b) A health care professional who dispenses antibiotic medication pursuant to this article shall not be deemed to have violated the standard of care for dispensing such medication in any civil or criminal action.”
